14.2 Binding Arbitration
If we cannot resolve the dispute informally, then, to the extent permitted by the law of Pomeranian, Poland, any claim, controversy, or dispute arising out of or relating to these Terms or your use of the Site may be resolved by binding individual arbitration, administered by a recognized arbitration body in Pomeranian, Poland under its applicable rules then in effect.
• The arbitration will be held in Pomeranian, Poland, or by phone or written submissions if you prefer.
• The arbitrator's award is final and binding.
• The arbitration laws applicable in Pomeranian, Poland govern the interpretation and enforcement of this arbitration agreement.
• Each party pays its own costs and fees, except as required by the applicable arbitration rules or law.
• Nothing in this Section removes any non-waivable right you may have under the law of your country of residence, including any right to bring proceedings in your local courts or to mandatory consumer protections.
14.3 Class Action Waiver
You and we agree that any claim will be brought only in your or our individual capacity, not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate claims of multiple parties or preside over any class proceeding.
14.4 Exceptions
Arbitration does not apply to:
• Claims that may be brought in small claims court, if eligible
• Claims for injunctive or equitable relief related to intellectual property rights
• Disputes that applicable law does not allow to be arbitrated
14.5 Opt-Out
You may opt out of this arbitration agreement by sending written notice to us within 30 days of first using the Site. Your notice must include your name, the email address you use with the Site, and a clear statement that you are opting out of arbitration. Opting out will not affect any other part of these Terms.
14.6 Severability of This Section
If the class action waiver is found unenforceable, the remainder of this Section 14 will remain in effect.
These Terms are governed by the laws of Pomeranian, Poland, without regard to its conflict of laws principles. For any matter not subject to arbitration, you and we agree to the jurisdiction of the courts located in Pomeranian, Poland, except where mandatory local law gives you the right to bring proceedings in the courts of your own country of residence.
If you live outside Pomeranian, Poland, you may have additional rights under your local law that cannot be limited by contract. Nothing in these Terms is intended to override those rights.
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Site at any time. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — will survive.
